Judicial notice is an underutilized tool that can save time and money by eliminating the need for expert witnesses, but is complicated by scientific replicability issues and the explosion in use of artificial intelligence (AI). How can you use it correctly and effectively in your cases?

This program will cover:

  • The evidentiary law of judicial notice in New York State versus federal courts
  • When and to what extent a court may take judicial notice of facts sua sponte
  • How a court may take judicial notice for scientific and mathematical principles, and when that must be left to expert testimony
  • Motion practice with respect to judicial notice, including motions in limine
  • The ongoing replicability crisis in scientific publication and how AI can either help or compound the problem, and ways in which attorneys and judges may identify these problems in their own cases.
