Pandemic Planning in the Workplace

Coronavirus, seasonal flu, Ebola – the news is filled with stories about global (and local) health threats, raising concerns for employers and employees alike about workplace protections, including:
· What can an employer do as a practical matter to help protect its workers and customers?
· Should an employer institute a travel ban to certain countries? If an employee has potentially been exposed to a dangerous virus, is it legal to require medical testing or a quarantine before returning to work?
· May an employee refuse to work based on concerns about exposure, or insist on protective measures or work accommodations inconsistent with the employer’s mission (e.g., refusing to work with customers or co-workers whom the employee perceives as an exposure risk)?
· Should employees have a written pandemic plan, and if so, what should (and what shouldn’t) it contain?
