The Appellate Division, Fourth Department, is soliciting interest for the position of Court Examiner. Court Examiners are appointed for each county on an annual basis to assist with the Court’s oversight requirements with respect to guardianships within the Fourth Department established pursuant to Mental Hygiene Law article 81. Appointed Court Examiners will be required to engage in training and qualify under Part 36 of the Rules of the Chief Judge.
The duties of the Court Examiner include reviewing initial and annual reports of guardians of the person and property, including the review of bank statements and other financial documents; preparing a Court Examiner’s report with respect to each guardianship report, to be filed with the county clerk and the Appellate Division; maintaining communication with guardians to assist with their duties and ensure compliance; communicating with the trial court regarding lack of compliance, and engaging in motion practice, when necessary, to compel compliance; and performing other duties as the Presiding Justice may direct.
A Juris Doctor (JD) degree from an accredited law school and admission to the New York State bar are required. A compensation schedule for the review of reports can be found in the Rules of the Appellate Division, Fourth Department (see 22 NYCRR 1015.16).
