Title Attorney

Examine Title for real estate, on behalf of the company and insure that title is free of liens, claims and legal questions as to ownership of the property. Assist in the closing of real estate transactions.

Principle Duties & Responsibilities

  • Perform Title Examination to determine the conditions of the title to be insured and to evaluate the risk to be undertaken in the issuance of a title insurance policies and title insurance policy endorsements and other title insurance documents.
  • Draft documents associated with deeds, easements, use restrictions, affidavits, leases, surveys, contracts and other matters associated with title to property.
  • Order Title Abstracts, surveys and prepare Title Commitments (if not prepared by the Title Company) for property to be purchased by the company. Examine acquisition documents, abstracts of titles, Title Commitments including leases, easements and use restrictions and other legal documents to determine ownership of Property. Search for and examine public records to determine the ownership, existence of financing, liens, use restrictions and other encumbrances and their effect upon title for properties under consideration by company management.
  • Determine proper execution, acknowledgment, and delivery of all conveyances, loan documents, organizational documents and other title instruments which may be necessary to the consummation of the sale, purchase or loan transactions.
  • Review and determine that all delinquent taxes are paid, all current taxes, based on the latest available information, have been properly prorated between the purchaser and seller, all proceeds have been properly disbursed, a final search of the title has been made, and all necessary legal documents have been filed for record.
  • Assist in the drafting of purchase and sale agreements.
  • Prepare letters of intent in connection with the purchase of property including costs associated with Title.
  • Prepare and maintain company policies associated with the operation of an in-house title agency. Apply for and obtain a NYS Title Agent License.
  • Communicate with internal and external attorneys and company management regarding questions and concerns about title to existing company property.
  • Provide support and training to company attorneys on title related issues.
  • Assist company attorneys with real estate closings.
  • Provide support to legal department and executive management in investigating and resolving ancillary legal issues.
  • Continuous communications with internal and external attorneys in obtaining information or problem resolution. Frequent contact with Company executive management.

Qualifications

  • 3 - 5+ years’ experience in title examination.
  • JD degree from accredited law school with admission to the New York State Bar preferred, or experience as a title paralegal.
  • Excellent legal research, writing and computer skills, with working knowledge of MS Office software. Excellent communication and interpersonal skills. High level of attention to detail.

Salary Range $100,000-$150,000
