  • New business/current issues:


  • On October 5, 2021, the New York State Department of Environmental Conservation released water quality guidance values for three emerging compounds, PFOA, PFOS, and 1,4-Dioxane.  The comment period for the draft guidance values runs until November 5, 2021.  Comments can be issued to the Department at 625 Broadway, 4th Floor, Albany, NY 12233-3500, ATTN: Michelle Tompkins or by email to AWQVinformation@dec.ny.gov.  The press release concerning the guidance is available here: https://www.dec.ny.gov/press/123915.html.


  • Based on the feedback I received, I recommended the BAEC Board support the proposal from the NYSBA Environmental and Energy Law Section concerning amendments to the Brownfields Cleanup Program. On Tuesday, October 12, the BAEC Board accepted my recommendation and voted to support the proposal.


  • On the ballot: Proposition 2: Right to Clean Air, Clean Water, and a Healthful Environment. This proposed amendment to Article I of the New York State Constitution would establish the right of each person to clean air and water and a healthful environment. Information on the language of the proposition is available here: https://www.elections.ny.gov/2021BallotProposals.html.
