New York’s “serious injury threshold” serves as a gatekeeper, limiting the class of plaintiffs who can recover in tort for automobile accident-related injuries.

The process of separating the “serious injury” from non-“serious injury” is a “complex, fact-laden determination” (Pommells v. Perez, 4 N.Y.3d 566, 571 (2005)) -- the verbal statutory categories being an “elusive standard that all too frequently escapes facile and final resolution” (Brown v. Achy, 9 A.D.3d 30, 31 (1st Dept. 2004)).

This CLE will explore recent New York decisions involving the “threshold,” attempting to convert “the sometimes frustrating task” (see Brown, 9 AD3d at 31) into something more manageable.
